Expert doubt: the payment for the assessment of housing when buying it for the mother capital is proposed to be canceled
Russians who buy housing with maternity capital will not have to pay for its assessment. Such amendments to the legislation are being prepared by State Duma deputies. The main condition is that the house must be no older than five years after construction. Currently, home buyers for maternity capital in 26 Russian regions are forced to pay up to 40 thousand rubles for its assessment. For families with children in the regions, this is sometimes an unbearable expense.
Expertise when buying a home for the mother capital
The State Duma proposes to exempt parents who have received maternity capital from a paid examination of housing if it was built less than five years ago. Such a bill was prepared by deputies of the United Russia faction Svetlana Razvorotneva and Tatiana Butskaya. This measure, according to lawmakers, should mitigate the effect of the adopted law, according to which Russians must make a mandatory examination of the fact that they are habitable before buying a home and, thus, the funds of the parent capital are spent in a targeted manner.
The law on the mandatory assessment of the suitability of residential premises for living before its purchase at the expense of the parent capital was adopted in December 2024. According to him, the reason for refusing to use the funds of the maternity capital is, among other things, the lack of a conclusion on the compliance of the premises with the requirements for livability. It should be issued by interdepartmental commissions, which include representatives of the housing inspectorate, Rospotrebnadzor and other departments. As noted in the accompanying materials to the law, it was supposed to prevent a fraudulent scheme for the purchase of housing, when the parent capital was actually cashed out when purchasing premises that were not suitable for living.
— The purpose of the adopted law was to protect the rights of children to housing. However, after its entry into force, we began to receive numerous appeals from citizens and members of the professional community of realtors that in many municipalities people are required to obtain an opinion from a specialized organization, and they are offered to pay for it by citizens themselves," Svetlana Razvorotneva, deputy chairman of the State Duma Committee on Construction and Housing and Communal Services, explained to Izvestia.
According to her, in order to determine the scale of this problem, the deputies conducted a study, which showed that residents of about 26 regions faced this situation. Moreover, the amounts that had to be paid to citizens for such an assessment of housing reached 40 thousand rubles. And in some cases, additional requirements were imposed on families. Among other things, they had to provide an opinion from the sanitary and epidemiological supervision authorities, a construction permit, although the house had already been built, requirements to complete the finishing work — to put all sockets and switches, redo engineering communications, etc.
— That is, despite all the recommendations of the federal authorities and the established procedure, today the regions and municipalities are introducing their own rules, which, unfortunately, greatly complicate the lives of families. Therefore, we want to correct this situation, and together with the Ministry of Construction and the Ministry of Labor, we want to take a number of measures," Svetlana Razvorotneva explained.
In this regard, the State Duma proposes not to require such an assessment from the public when buying real estate built less than five years ago. In addition, the results of the examination should not be provided by citizens who purchase an apartment through a mortgage or in a house built using escrow accounts, since in both cases there is a check by banks.
Also, together with the ministries, the deputies plan to develop clear methodological recommendations for regional authorities. They need to determine which requirements can and cannot be imposed. The State Duma emphasizes that conditions such as, for example, the installation of sockets are redundant.
— Any law that we adopt goes through a lot of expert discussions: both in the State Duma and in the Federation Council. This is done so that it starts working immediately. There are cases when its implementation requires special control. This happened with the adopted law on housing valuation, which protects families from buying "uninhabited" housing for the mother capital," explained Tatiana Butskaya, first deputy chairman of the Committee for Family Protection, Fatherhood, Motherhood and Childhood, to Izvestia.
According to her, there was a loophole for scammers who began to charge people for housing appraisals, a service that should be provided by the state for free.
In this regard, the deputies, the authors of the bill, sent official appeals to the Ministry of Labor and the Ministry of Construction with a proposal to discuss solutions to the problems faced by Russians.
Izvestia sent requests to these departments asking them to comment on the prospects for supporting the appeals of deputies.
Why housing with maternity capital has become burdensome
The Russian Guild of Realtors (RGR) has already drawn attention to the situation. Almost immediately after the entry into force of the law requiring an assessment, they sent letters to Prime Minister Mikhail Mishustin, as well as to the State Duma and the Federation Council, asking them to take action.
"The guild began receiving appeals from the regions complaining about problems related to the fact that local officials do not have clear regulations. The members of the RGR give examples of delaying approvals, postponing transactions for a period of one to two months. In some cases, it is extremely dangerous to enter into transactions, because if it is not possible to obtain this conclusion, then all parties will have problems and, most likely, they will have to go to court," the document said.
In this regard, realtors, among other things, proposed suspending the requirements for housing assessment until bylaws and mechanisms for implementing the law were approved. In addition, to optimize the submission of documents: to introduce the submission of applications through the Gosuslugi portal, which will take into account the reports of independent appraisers and other documents confirming the suitability of housing.
— The situation has not changed today. In this regard, we have sent an appeal to the State Duma with a request to consider amendments to 495-FZ on the agenda of the autumn session, where one of the proposals was to exclude this requirement for transactions with mortgage funds, and in other cases replace this conclusion with an independent appraiser's report," explained Oksana Bayramova, a lawyer at the RGR.
The government should have introduced some rules to the regions regarding the recognition of housing as uninhabitable, but this has not been done, says Konstantin Barsukov, a member of the guild.
— The administrations were simply told to act on the basis of already existing regulations of the Cabinet of Ministers. As a result, the local authorities were shocked and began to do everything on their own. It turned out that in order to use the funds of the parent capital, people have to pay money, and sometimes a lot of money," he explained.
According to him, when the Cabinet of Ministers found out that money was being taken from the population, they sent recommendations to the regions to stop this practice. However, since these are recommendations, not all of them have been fulfilled, but the versatile requirements have remained, Konstantin Barsukov explained.
