Motorists who have received CTP compensation will be able to count on an additional payment from the insurance company if the initial amount was not enough to restore the car. The relevant amendments to the legislation have been prepared by deputies and the insurance community and will be submitted to the State Duma in the near future. Izvestia found out under what conditions the proposed scheme will operate and what additional payment car owners will be able to expect.

Additional refund

The insurance community advocates reforming the system of in-kind compensation for CTP, offering to supplement it with the possibility of receiving additional payments for avtograzhdank. This was stated by Evgeny Ufimtsev, President of the Russian Union of Motor Insurers (RSA), during a round table on auto insurance. He noted that the existing procedure for in-kind compensation for CTP will remain, but additional options will be added to it. According to the head of the RSA, the relevant amendments to the legislation have already been supported by the Ministry of Finance and the Central Bank and will soon be submitted to Parliament for consideration, taking into account comments received from the Supreme Court and the Financial Commissioner's Support Service.

— We tried not to change the current procedure for receiving insurance payments, but to supplement them. That is, when an insurance company has the opportunity, in the presence of a service station, to send a car for repair with in—kind compensation, it does. However, if the insurance company, as often happens today, does not have the opportunity to send a customer's car for repair and an insurance refund is paid, then after receiving the insurance payment, the victim can repair himself and with this he gets the right to contact the insurer for an additional payment within the amount of wear, " Evgeny Ufimtsev said about the proposed changes.

The press service of the RSA told Izvestia that these are amendments that are scheduled to be introduced by the second reading to the draft law, which provides for an increase in the period of CTP repair from 30 to 45 days.

You can't fix it and you can't pay

Due to the sanctions and the withdrawal of many foreign automakers from the Russian market, the share of compensation for Avtograzhdank in kind has noticeably decreased, the president of the RSA noted. So, if in 2019 the share of repair orders issued by insurers was 15% of the total number of settled insurance claims for CTP, then by the end of last year it decreased to 5%.

— Service stations simply cannot meet the requirements for the terms of repair, which are specified in the legislation, and therefore often refuse to conclude contracts with insurance companies. After all, it is not uncommon for the delivery time of a particular part to exceed 30 days, which, according to the law, are allotted for CTP repairs," said Evgeny Ufimtsev.

According to him, even the announced increase in this period to 45 days will not completely solve the problem. The proposed scheme, according to which a motorist, after receiving initial compensation, will repair the car, and then contact the insurer for additional compensation, "will make CTP more interesting and attractive to consumers," said the president of the RSA.

How to get additional compensation

The RSA told us what the proposed scheme of additional compensation would look like. For example, an expert technician made a calculation, according to which repairs are estimated, conditionally, at 150 thousand rubles, wear on spare parts — 50 thousand rubles. In accordance with the law, the insurer will pay 100 thousand rubles in cash — this amount is due as part of the compensation for the CTP loss. At the same time, the insurance company offers the victim to arrange car repairs on his own, show the restored car and present documents about the repairs. After that, the insurer will pay these 50 thousand rubles, that is, it will compensate for the cost of depreciation. All calculations of the cost of CTP repairs are made on the basis of the average cost reference books provided for by the Unified Methodology of the Bank of Russia, the RSA noted. The Union also said that repairs should be carried out within nine months from the date of the first payment.

If, during the repair, hidden damages were discovered that were not visible during the initial inspection, and as a result, the restoration of the car cost more than the conditional 150 thousand rubles, then in order to receive compensation, the car owner must fix the identified hidden defects and inform the insurer about them. The deadline for applying for such a repeat payment, according to the proposed changes, will be 90 days, the RSA noted.

It won't affect the policy.

The Central Bank supports the proposal to enable motorists to independently choose a service station to repair a car after an accident under CTP, Nikita Teplov, Deputy Director of the Insurance Market Department of the Bank of Russia, said at the round table. But at the same time, the motorist himself is responsible for the repair results, he stressed.

Insurance companies themselves also support these proposals. They note that, despite the possibility of additional payments, the cost of the policy will remain unchanged. According to Dmitry Popov, Ingosstrakh's executive director, these changes will not affect the CTP economy in general.

— Due to additional compensations, the amount of payments will certainly increase. However, at the same time, the costs of companies for fines, penalties and other court costs currently borne by insurance companies will decrease. In fact, one thing balances the other," he noted.

Reference books and life

The idea of additional payments is quite interesting in itself, but it all depends on the reference books used to calculate the cost of repairs, Anton Shaparin, vice president of the National Automobile Union, told Izvestia. The prices indicated in them often have little to do with both the actual cost of spare parts and the tariffs of technical centers.

— For example, according to the current version of these reference books, the front headlight on a Renault Arkana is estimated at 49,590 rubles. However, on one of the most popular classifieds, it costs 130-140 thousand rubles. The same applies to the official prices for the services of technical centers. According to these reference books, in Moscow, the standard repair time for a Porsche is "estimated" at 1,050 rubles. Obviously, it is simply impossible to repair such a sports car for this amount," said Anton Shaparin.

Proposals on the possibility of additional payments are "a significant step forward," says Igor Morzharetto, a member of the presidium of the Public Council under the Ministry of Internal Affairs of the Russian Federation. According to him, even though there are certain discrepancies between official prices and real prices, now motorists "don't get that either."
