Passion is not joy: a woman who ordered her lover to kill her husband was given 17 years
The Moscow Regional Court sentenced Viorika Kondratyuk, who ordered her husband's murder by her lover, to 17 years in a general regime penal colony. According to investigators, the woman estimated the crime at 1.8 million rubles. The man committed the murder, took the money hidden in the children's "cheesecake" in the entrance, and left for the neighboring city. But I soon found out that the package contained dummy bills from the bank of jokes. And with real money, he received only 60 thousand for the preparation of the crime and 3 thousand for the ticket after it was committed. How the testimony of the suspects changed during the investigation and whether the verdict could be considered harsh is described in the Izvestia article.
How was the murder organized
Viorika Kondratyuk, a resident of the Moscow region, was sentenced to 17 years in a general regime colony by the Moscow Regional Court. She was accused of organizing the murder of her husband. According to the case file, the woman asked her lover to commit it, promising him 1.8 million rubles.
At the same time, the accused tried to save money on payment — the money turned out to be tickets from the bank of jokes. Her lover picked them up at an agreed place — they were hidden in a children's "cheesecake" in the entrance.
The court found Kondratyuk guilty of several counts at once: attempted murder, organizing a murder for mercenary motives for hire and illegal possession of narcotic drugs. The latest article is related to Kondratyuk's previous attempt to get rid of her husband. According to the Moscow Region Prosecutor's office, she and her lover tried to poison him.
"In February 2024, they purchased methadone, and the woman, while in an apartment located in the urban-type settlement of Selyatino in the Naro—Fominsk city district, mixed the drug into her husband's soup," the supervisory authority said.
During the preliminary investigation, Viorika Kondratyuk confessed to organizing the murder, but later began to deny her guilt. Before the verdict was announced, she also stated that she did not organize the murder and did not understand the motives of the lover who committed the crime.
"I don't know what happened," she said, turning to the wall. — I don't know why he did it, or because of jealousy, or because of money.
When asked what sentence awaits, the defendant replied: "What will happen will happen."
What the accomplice said
Testimony against Viorika Kondratyuk was given by her lover, Rinat Kazgaliev. At first, he also denied her guilt, but fully admitted his own. Later, Kazgaliev explained that he had been covering for Kondratyuk because he believed that she would give birth to their child. After learning that the woman had an abortion, the accused confessed who had ordered the murder.
He also told about the poisoning attempt: he bought drugs with Kondratyuk's money, handed them to her, and she had already mixed them into her husband's food. But the spouse recovered.
After that, the murder was planned in the entrance of the house. According to Kazgaliev, Viorika Kondratyuk brought him a knife and an axe, dropped 60 thousand rubles into a bank card, including for the purchase of overalls and balaclavas. The woman, according to the accused, promised him a reward of 1.8 million rubles.
"I hit him first with an axe, then he fell, and stuck a knife in his throat. I stabbed him in the hood for the third time," he said in his testimony. "She promised money." I called her right away, she told me where [the board] was, and there was a dummy. Then she added [my phone] to the blacklist. About 30 minutes later, I dropped 3,000 rubles on my brother's card, and I went home."
What Viorika Kondratyuk told me
At court hearings, Kondratyuk admitted that she had put something in her husband's soup, but, according to her, it was a laxative, not a drug. She stated that she wanted to cause her husband "minor harm" because he was beating her. According to the woman, she received a package of powder from her lover. Kondratyuk denied that she had transferred money to Kazgaliev to buy drugs, saying that it was money to pay for gasoline. According to her, she had previously transferred money to her lover for these purposes.
Her marriage at that time was already "formal": her husband lived in another apartment and came only to their daughter, the woman added. The couple constantly quarreled, over time the situation worsened and conflicts began to be accompanied by physical abuse. They did not file for divorce, as her husband promised to provide for the child.
Kondratyuk said that Kazgaliyev promised to solve her problems with her husband with the help of influential people. He also offered the woman to move in with him, but she did not want to leave because of the proximity of the kindergarten and the clubs where the child went.
Also, according to Viorika Kondratyuk, it was Kazgaliev who asked her to buy notes from the bank of jokes.
But in March 2024, two days after the murder, she stated something completely different at the confrontation. According to the protocol, Kondratyuk said that she wanted to divorce her husband, but was afraid that her husband would find out about her lover and debts. She decided to kill him, but not with her own hands. She admitted that she had agreed with Rinat Kazgaliev to do this. And since her husband had several apartments, after inheriting, she promised her lover to transfer one of them to him.
"During the whole day, Rinat and I corresponded on various topics, and in the evening Rinat called me and said that he had done everything," the case file says.
Over the following days, Kondratyuk confirmed that she was aware that she had ordered the murder of Kazgaliev, "who carried it out on March 4, 2024." "I regret what I have done," her statement says. However, she later refused them, saying that she was in a state of shock.: The husband is dead, the children were crying.
"I did not give such testimony, I did not know that it was possible to take Article 51 (guarantees the right not to testify against oneself. — Ed.)," she said.
Viorika Kondratyuk has filed six complaints with the prosecutor's office. According to her, during the preliminary investigation, she received threats about depriving her daughter of citizenship, interrogations took place at night, and she was told that if she did not testify, her children would "go to an orphanage."
Why was the verdict harsh
Experts interviewed by Izvestia called the verdict quite harsh.
"Given the severity of the punishment, there is reason to believe that the decision will be appealed," says Yuri Levin, a lawyer at branch No. 1 of the Moscow Regional Bar Association.
According to him, usually women, especially those with a mitigating circumstance in the form of minor children, show more leniency. Yuri Levin suggested that the nature of the sentence was explained by the fact that the convict had made more than one attempt to get rid of her husband.
"Therefore, the sincerity of repentance, if any, will remain in doubt,— he said.
The articles on which Kondratyuk was convicted are particularly serious crimes, for which the law provides for a penalty of up to 20 years in prison, said Veronika Polyakova, a criminal defense lawyer and managing partner of the Business Legal Group Bar Association.
"The total term is longer, but the maximum term of imprisonment cannot exceed 20 years, and life imprisonment is not imposed on women," the lawyer reminded. — The presence of dependent children could become a mitigating circumstance and influence the punishment imposed.
The lawyer added that such stories are much less common in legal practice than fraud or battery cases. However, Yuri Levin said that situations where spouses decide to commit murder are not uncommon.
