The deputies of the State Duma approved amendments to the Administrative Code, which prohibit the repeated execution of fines for the absence of a CTP policy during the day. This rule will only apply if such a violation is recorded by cameras. Izvestia found out the details.
The penalty is once every 24 hours
At the plenary session, the State Duma adopted in the first reading a draft law establishing a special procedure for imposing fines for the absence of a CTP policy, detected with the help of photovideofixation complexes.
As follows from the text of the document, a note is added to Article 12.37 of the Administrative Code of the Russian Federation ("Non-compliance with the requirements for compulsory civil liability insurance for vehicle owners"). If cameras detect a vehicle that does not have a CTP policy, a fine for this violation is imposed no more than once a day. The fine remained the same: 800 rubles for the first time, and from 3 thousand to 5 thousand rubles for repeated misconduct.
"The owner (owner) of the vehicle in case of an administrative offense, [absence of a CTP insurance policy — Izvestia] <...> it was recorded by special technical means operating in automatic mode, <...> and two or more times during the day <...> after the moment of the first fixation of such an administrative offense, it is not brought to administrative responsibility for the second and subsequent cases during the day when such an administrative offense was recorded," the explanatory note says. to the document.
According to Anatoly Aksakov, one of the authors of the bill, Chairman of the State Duma Committee on the Financial Market, the adopted amendments are needed in connection with the expected launch of automatic recording of the insurance policy using video cameras.
— In the current wording, the legislation would allow drivers to be fined for driving without CTP under each camera. The bill stipulates that if a violation is recorded by a traffic camera, then the car owner should not receive more than one resolution every 24 hours," the parliamentarian noted.
Anatoly Aksakov also clarified that video monitoring of CTP policies will be launched in a test mode in Moscow, St. Petersburg and Chuvashia. Initially, drivers who do not have a "car citizen" will receive only notifications for Public Services, without fines, the deputy noted. Only after the system is fully debugged, the traffic police will begin issuing fines for driving without CTP based on video recording, he said.

Cameras will restrain the growth of CTP prices
Checking the availability of CTP policies using photo and video cameras will primarily affect those car owners who use vehicles in places with a high concentration of traffic cameras - large cities, federal, large regional highways, according to the Russian Union of Motor Insurers (RSA). Drivers, knowing that the main part of their journey is monitored by cameras, tend to be more disciplined in their behavior on the road, the Union notes. The RSA expects that monitoring insurance with the help of cameras will reduce the number of motorists who do not apply for a policy. Currently, the share of such drivers is 7-10%, and most often it is highly accident-prone motorists who neglect the obligation to insure their car liability, the RSA told Izvestia.
— The insurance community supports this initiative, which will help identify not just random violators, but car owners who systematically ignore the provisions of the CTP law. We expect that this measure will have a positive impact on the situation on the roads in general. In turn, a decrease in the share of car owners without policies will have a positive impact on the safety of other road users, that is, there will be a guaranteed opportunity to resolve all issues of damage compensation with the insurance company. Checking the cameras for a policy will also make it possible to more effectively curb the growth of insurance premiums, since bona fide vehicle owners will not have to "pay extra" for those who drive without a policy, said Evgeny Ufimtsev, President of the RSA.
As explained in the RSA, the expected entry into force of the law from September next year is due to the need to complete the modernization of the service for automating the activities of the relevant Traffic Police centers based on special software "Web" and working out the mechanism for issuing fines.
Unresolved issues
Everyone who goes out on the road should have a CTP policy, Maxim Kadakov, editor-in-chief of Behind the Wheel, notes. And the ability to monitor the availability of insurance makes it possible to ensure compliance with this requirement, he believes. At the same time, an important condition is to guarantee the minimum number of failures of such a system, he emphasizes. However, the adopted bill does not solve a number of significant issues, Maxim Kadakov draws attention.
— For example, there remains the problem of driving a vehicle by a driver who is not registered in the insurance. Yes, there is a policy for the car, but the camera cannot check whether the person specified in the insurance contract is driving it," Maxim Kadakov noted.
Another issue concerns the speed of the appearance of data on the fine in the unified information system, according to the editor-in-chief of Za Rulem.
— Let's say the camera recorded that the car is not insured. A kilometer later, the car is stopped by a traffic inspector and checks for CTP. The fine from the camera has not yet been issued, and neither the drivers nor the policeman know that this violation was already recorded five minutes ago. Accordingly, the motorist receives another fine for the absence of CTP, which has already been issued by the policeman. A few kilometers later, another car inspector checks the documents for the car, who issues the third fine. Therefore, by the second reading, it makes sense for the deputies to provide for such a scenario, and with this in mind, finalize the document," Maxim Kadakov believes.
