In the first six months of 2025, Russians imposed more than 700,000 bans on registering real estate transactions without personal participation, the Federal Register reported. The indicator has more than doubled compared to the same period last year. Izvestia figured out what this is about and how to protect yourself when buying and selling real estate.

Necessary protection

A ban on transactions without the personal participation of the owner is entered into the Unified State Register of Real Estate (USRN) at the request of the copyright holder, the press service of the Federal Register told Izvestia. This measure is one of the most reliable ways to protect against fraud attempts and prevent illegal real estate transactions. The service has been in operation since 2013 and continues to show its relevance as one of the most reliable tools in the fight against fraud.

"The active dynamics indicates that more and more citizens are taking measures to protect their property. At the same time, the number of applications submitted electronically is growing. After making such an entry in the Unified State Register of Legal Entities, all applications submitted in respect of a real estate object without the personal participation of the copyright holder or his notarized proxy will be returned without consideration," the federal service said.

It should be remembered that Rosreestr employees never call owners with messages about the threat of fraud or requests to provide their personal data. If you suddenly receive such a call and the person introduces himself as an employee of the Federal Register, you should immediately report this to law enforcement agencies. Do not fall for the tricks of scammers. Don't go along with them, so as not to lose your real estate. The easiest way to protect real estate is to apply for a ban on registration of transactions without your personal participation. This can be done in your personal account on the Rosreestr website, on the Gosuslugi portal, or at the MFC.

"Order extracts from the Unified State Register of Legal Entities only using the official Rosreestr website or the public services portal. Do not use Internet services that provide the opportunity to receive unofficial property reports. After receiving your personal data, these sites/services may store it and further use it in their illegal activities. In addition, they are not responsible for the completeness and correctness of the information provided to you," the Rosreestr noted.

The federal service advised to add your email address to the Unified State Register of Legal Entities and promptly update it in case of a change in e-mail. This can be done in your personal account on the Rosreestr website, on the public services portal, or at the MFC. Rosreestr also recalled the need to carefully check documents before real estate purchase and sale transactions.

"First of all, buyers should take into account that only the owner can sell the property. Therefore, you should first carefully study the title documents. These include contracts of transfer (privatization), donation, purchase and sale, participation in shared construction, etc. That is, the documents on the basis of which the ownership of the current owner or owners of the property arose," the Rosreestr noted.

In addition, ask the seller to provide an extract from the Unified State Register of Legal Entities on the main characteristics and registered rights to the property, the agency noted. It will also help to make sure that the seller of the apartment is its rightful owner.

Russians have become more active in using the ban on registration actions without personal participation as a tool to protect themselves from fraudsters, Ekaterina Podolskaya, an expert at the Presidential Academy in St. Petersburg, told Izvestia. In fact, this is a "lock" on the property — it is impossible to conduct a transaction without the presence of the owner. The growth of more than two times indicates that people are aware of the real risks in the market and are ready to act proactively.

"When buying and selling real estate, security begins with an informed decision about the transaction and a properly executed contract," she clarified. — The document must specify all the conditions in detail: the exact characteristics of the object (address, cadastral number, area), the price in both numbers and in words, the calculation procedure, the terms and conditions of termination. I recommend making transactions through a notary. This not only reduces the risk of errors, but also allows you to use secure forms of payments: letter of credit, escrow account, notary's deposit or safe deposit box.

It is easy to establish a ban: the application is submitted to Rosreestr online through the Gosuslugi portal or personally to the MFC, the expert recalled. It can be removed only at the will of the owner, by court order, or as part of a notarial transaction with his personal participation. Exceptions are rare, such as hereditary cases.

— Today, a competent owner protects his property not only with alarms and door locks, but also with legal tools. The ban on transactions without personal participation is one of the most effective of them, says Ekaterina Podolskaya.

The popularity of the service is directly correlated with the development of fraudulent schemes, their number and scale, as well as their extensive media and social media coverage, Fyodor Vylomov, an expert in the Popular Front, told Izvestia. Thousands of crimes related to real estate scams occur every year, and their scale is estimated at tens or even hundreds of billions of rubles.

— One of the most popular schemes is the sale of forged powers of attorney or gift agreements. And this is where the ban on registration of transactions without personal participation helps," the expert noted. — At the same time, it is worth remembering about the classic ways of self-protection during purchase and sale: be careful, check all documents, including the absence of encumbrances, arrests and legal disputes, as well as involve notaries in the transaction.

In recent years, we have seen an increase in the activity of fraudulent actions against citizens, including those related to the purchase of housing, said Vladimir Prokhorov, a member of the General Council of Delovaya Rossiya. If the developer provides a guarantee of reliability in the primary market, then risks remain in the secondary market.

— You can encounter both scammers and unreliable realtors. One of the safest ways to purchase real estate remains the legal verification of ownership facts. At the same time, it is worth paying attention to the reputation of the company that handles the transaction. If you are buying a house through intermediaries, then you should use the services of a lawyer to verify the purchase agreement," the expert warned.
